Op-ed: Latinos deserve equal access to paid leave and workplace ...

For too many Latinos in the United States, being a good worker and a good family caregiver are mutually exclusive. Across the country, Latino workers are the least likely of any racial or ethnic group to have access to paid sick days, paid parental leave, paid vacation, or any form of workplace flexibility. Latino workers are also more likely to be employed in low-wage or part-time jobs, where the line between just getting by and destitution can rest on a single day?s pay.

U.S. policies surrounding paid leave and flexibility for workers are notably antiquated. For one, the United States is the only nation in the Organisation for Economic Co-Operation and Development that does not guarantee paid leave to workers after the birth of a child. The United States is also one of only a handful of nations?alongside places like North Korea and Chad?that does not guarantee paid sick leave when a worker is too ill to work.

Coupled with this stark divide between the United States and the rest of the developed world, the configuration of the American family has also changed drastically over the last few decades, markedly increasing the need for improved leave and flexibility policies. Only one in five families today (20.7 percent) consist of a male breadwinner and a female homemaker (compared with more than half of families in 1975). It is far more likely that a family is led by a single parent (31.9 percent of families) or by two working parents (the remaining half). Without a full-time, stay-at-home caregiver, parents without paid leave must too often choose between missing a day?s work?and pay?or caring for a sick child or, increasingly, an elderly parent.

Changing the status quo is even more urgent for Latino workers. A recent series of issue briefs from the Center for American Progress highlight findings on workers? access to paid leave and flexibility based on 2011 data from the Bureau of Labor Statistics? American Time Use Survey. The data provide a compelling and sobering portrait of Latinos? lack of access to paid leave and workplace flexibility.

Despite comprising just 13.3 percent of the U.S. workforce, Latinos make up one-quarter (24.5 percent) of all workers who lack both flexibility and any form of paid leave. Of any racial or ethnic group, Latinos are also the least likely to have access to paid sick days (only 38.4 percent) or paid parental leave (only 25.1 percent). They also have the least access to flexible hours (under 40 percent),which would allow them to shape their schedules to better fit non-work obligations.

One explanation for Latinos? disproportionate lack of these vital benefits is the nature of their work. More than 56 percent of Latino workers are in the bottom 40 percent of earners, and low-wage jobs on average offer the fewest benefits and employee protections. This becomes of greater concern as we look at prospects for job growth in the United States over the coming years and decades. Low-wage jobs made up 21 percent of all job losses during the Great Recession of 2007 to 2009 but have made up nearly 60 percent of job gains during the recovery. Employees today are working harder than ever before and bringing in record profits for their employers without commensurate increases in their own salaries or improved access to benefits like paid leave.

Some opponents of paid leave legislation argue that workers do not need leave that is specifically earmarked for illness or birth when they can take paid vacation instead. Fewer than half (44.3 percent) of Latino workers, however, even have access to paid vacation, and those that do cannot use vacation time on a moment?s notice?when a child wakes up with a high fever, for example, and a father needs to take an unplanned sick day.

Anyone who has ever gotten the flu, needed to care for a sick loved one, or welcomed a new child into their home should understand that there are times when employees cannot be at work?but too often that means losing a day?s pay. With the aging of the baby boomer population and the increasing need for family caregivers as a result, these problems will only grow more urgent.

Good public policies for workers are crafted to ensure all workers benefit?not just those with the highest salaries or the best jobs. Policies such as the Healthy Families Act, which would allow workers in firms with 15 or more employees to earn up to seven paid sick days a year; creating a national paid family and medical leave insurance program as the Center for American Progress has suggested; or implementing the kind of workplace flexibility promoted by the Obama administration could go a long way toward addressing these inequities.

Microsoft files patent for augmented reality smart glasses

Work on digital glasses that overlay information on top of the user?s view of the world has been carried out by Microsoft. A patent applied for by the US tech firm describes how the eyewear could be used to bring up statistics over a wearer?s view of a baseball game or details of characters in a play. The newly-released document was filed in May 2011 and is highly detailed. If a product comes to market it could challenge Google?s Project Glass. Google is planning to deliver its augmented reality glasses to developers early next year and then follow with a release to consumers in 2014. Smaller firms ? such as Vuzix, TTP and Explore Engage ? are also working on rival systems.

PHILADELPHIA (AP) ? They were two words on a sponsor's banner draped behind the Philadelphia Eagles' postgame podium: Imagine. Change.

For disgusted Eagles fans, that's all they can do, especially with coach Andy Reid still running the show. They won't have to imagine much longer.

After 14 seasons, one Super Bowl appearance, and, now a dreadful losing streak, the countdown to the end of Reid's tenure is hitting high gear in Philadelphia. Owner Jeffrey Lurie already has said that an 8-8 record would be "unacceptable" this year.

The Eagles would have to finish 5-0 just to get there after Cam Newton threw for two touchdowns and ran for two more to lead the Carolina Panthers to a 30-22 victory over the Philadelphia Eagles on Monday night.

Newton, who hadn't played up to his sensational rookie season, showed no signs of a sophomore slump against Philadelphia's porous pass defense. He finished 18 of 28 for 306 yards and had a passer rating of 125 in a matchup of teams with the worst records in the NFC.

Newton was only the latest player to shine against an Eagles (3-8) team about all out of hope. The Eagles haven't won since beating the defending Super Bowl champion New York Giants to go 3-1, a skid that has put Reid's job in real jeopardy. Unless Lurie has an implausible change of heart, Reid's run is about over, an inglorious end for the coach who led the Eagles to five conference championship games.

Lurie ducked out of a pregame press conference for the team's Hall of Fame before he could take questions from reporters. Reid said he hasn't discussed his job status with his boss.

"I'm not worried about all of the other things," Reid said. "I'm worried about winning football games and making sure I get my players coached up to where we do a better job with that."

As Philadelphia's seventh straight loss came to a close, some fed-up fans held up a banner that read, "Jeff This Is On You."

While Lurie surely joins Reid in taking a share of the blame for this ugly season, the players have been awful.

"I feel bad for Andy because he's in a horrible situation in a town that is critical, and rightly so," tight end Brent Celek said. "If I was the fans, I'd be mad, too. I don't see Andy as the problem. I see it as us."

Their latest problem was an inability to solve Newton.

Newton, the No, 1 overall pick in 2011, lived up to the hype by throwing for 4,051 yards with 21 TD passes and 14 TDs on the ground in his first year. He entered this game with only nine TD passes and four TDs rushing, a major disappointment for Panthers fans.

But Newton outshined rookie seventh-round pick Nick Foles in his Monday night debut.

Newton had a 24-yard TD toss over the middle to a wide-open Gary Barnidge for a 7-3 lead. He connected with Brandon LaFell on a 43-yard pass to make it 14-3 later in the first quarter. LaFell was wide open on the play, taking advantage of another breakdown in coverage in the secondary.

Newton led a 95-yard drive to open the third quarter, finishing it off with a 1-yard leap to give the Panthers a 21-15 lead. Newton hit Louis Murphy for a 55-yard gain on a second-and-11 from Carolina's 16.

"I think my best game is still to come," Newton said. "I'm still focused on getting better each and every week."

Carolina (3-8) went ahead 24-22 early in the fourth quarter on Graham Gano's 23-yard field goal.

"It's been a long time in coming," Panthers coach Ron Rivera said. "Lots of people contributed and made plays. Real proud of what we did and the things we did to give ourselves a chance to win."

Bryce Brown set an Eagles' rookie record with 178 yards rushing, including TD runs of 65 and 5 yards. Brown, filling in for injured running back LeSean McCoy, surpassed Correll Buckhalter's rookie mark of 134 yards rushing in his first start since his senior year at Wichita East High School in 2008. Brown also lost two fumbles, including one in Panthers' territory.

Foles was so-so in his second straight start for Michael Vick, who sat out with a concussion. Foles was 16 of 21 for 119 yards.

"The most important thing for me was for us to get the win and that didn't happen tonight," Brown said. "I felt like a lot of that had to do with my two turnovers. It really, really cost us."

After Gano's field goal put them up for good, the Panthers finally stopped Brown when it mattered most, stuffing him on a fourth-and-1 to take over on downs at their 40. Newton led them downfield, running in from the 2 to make it 30-22. Gano, signed last week, missed the extra point. But Brandon Boykin fumbled after a 44-yard kickoff return, the Panthers recovered and held the ball the final 4:29.

The Panthers have shown they're better than their record. They have lost six games by less than a touchdown, including a 2-point loss at Atlanta and a 1-point loss at Chicago.

"It's a huge stage, Monday Night Football, on the road," tackle Jordan Gross said. "It was just big for us and big for the guys on the team who haven't experienced something like this."

For the Eagles, it was simply the latest loss in a season stuffed with them. The Linc was quiet and empty except for some boos when busted coverage led to another Carolina TD. They fled for the exits once the Panthers took over for the final time.

Dwindling fan support is one thing. Losing it from Lurie is quite another for Reid.

"He's as competitive as anybody and he wants to win games," Reid said. "That's what he's in this business for."

The injury-depleted Eagles lost wide receiver DeSean Jackson (sternum) and defensive tackle Fletcher Cox (tail bone) in the first half. ... Android 4.2.1 update hitting Nexus 4 and Nexus 10

'December birthday' bug in People app fixed in latest OTA

According to reports from the Android Central forums and XDA, Google's new Nexus 4 and Nexus 10 devices are currently being upgraded over-the-air to a new version of Android, ver. 4.2.1. We've not yet been able to confirm whether 4.2.1 is also hitting the Nexus 7 or Galaxy Nexus, but we're sure these devices will get this latest update soon if it's not already going out.

The update fixes the notorious "December birthday" bug, which prevented any date in the month of December from being selected as a birthday or anniversary in the People app. So far we haven't noticed any other differences in the new software, which carries the build number JOP40D.

On the Nexus 4, the radio firmware version is unchanged from 4.2, and the hidden option that enabled some to use LTE on band 4 still seems to be present in the latest software. We can't verify first-hand that this unadvertised feature still works, but it doesn't look like this update has done anything to disable it.

As is always the case with these over-the-air updates, not all devices will get the update immediately, and we'd expect it to take a few days before everyone is up-to-date on 4.2.1. Nevertheless, we'll keep this post updated with direct links to the OTA packages for advanced users who want to flash them directly.

Can Restoration Hardware Legally Knock Off the Navy Chair?

The Emeco 1006, also called the ?Navy chair,? is an aluminum side chair produced by the Electric Machine and Equipment Company (Emeco) in Hanover, Pa. The chair was commissioned by the U.S. Navy in World War II for use on warships: The procurement contract specified that the chair had to be able to withstand torpedo blasts to the side of a destroyer.

After the war, Emeco began selling its Navy chair to the public.?The original design never sold particularly well, but over the years Emeco?s chair carved out a small niche as a piece of high-end (that is, expensive) design of the sort you?ll see featured in Dwell magazine.

That is until Restoration Hardware got into the act. Recently the big furniture retailer began selling a look-alike Navy chair, which it refers to as the ?standard aluminum side chair.? (It previously referred to it as the ?naval chair.?) The Emeco original is $455. The Restoration knockoff is $129. At that lower price?and given Restoration Hardware?s ubiquity and marketing muscle?the Navy chair was poised to go mainstream.

That was something Emeco was not going to take sitting down. The company has now filed suit, accusing Restoration Hardware of violating its trademarks. Restoration Hardware has apparently responded by taking the chair off its website. They shouldn?t have. The lawsuit is very likely meritless. And it points to the problem in granting overly broad rights in names and designs via the trademark system?especially since trademarks, unlike copyrights or patents, can last forever.

Let?s turn to the dispute itself. First, Emeco?s claim to a trademark on the term ?Navy chair? is weak. Why? Because over the years that has become a generic label for this type of all-metal, 1940s-style chair, rather than a name that immediately conjures up a Pennsylvania company named Emeco. And in American law, if a product?s name becomes generic?such as aspirin, linoleum, thermos, or zipper?it can no longer be trademarked. Lawyers call this ?genericide,? and the fear of becoming generic is one reason Kleenex is always reminding you that they sell ?Kleenex-brand tissues.? The makers of Kleenex are trying to save their brand from genericide by reminding you that Kleenex is a particular brand of tissues, not a generic name for tissues.

In any event, Restoration Hardware isn?t using the name ?Navy chair? anymore, so even if Emeco wins on this claim, it?s a pyrrhic victory?Restoration Hardware will be entitled to go on selling the chair under the unexciting but perfectly serviceable ?standard aluminum side chair? label.

But Emeco has a second claim. It argues that it has a trademark on the chair?s design as well as its name. This claim is also a stretch. The Supreme Court has been very skeptical of such ?trade dress? claims in which a firm asserts ownership over how a product looks. The court has said that firms can claim trademark rights on the design of products only if they have achieved what lawyers refer to as ?secondary meaning??that is, if the design is recognized by a substantial number of consumers as synonymous with the product itself.?

This is possible but very rare. The sinuous design of a Coca-Cola bottle is protected, for example, because people widely recognize a bottle of that shape as synonymous with Coke. Is Emeco?s Navy chair the home furnishing equivalent of a Coke bottle? No. It may be that a small number of industrial-design fans believe that chairs that look like the Navy chair come from a single source (such as Emeco). But actually they don?t?the Navy chair has been knocked off for years by a number of firms. Here?s a knockoff version by Advanced Interior Designs. Here?s another by Interiortrade. And here are knockoff Navy chairs in various colors by Globe West. Matt Blatt has done Navy chair knockoffs as well. Heck, at one point, even mega-retailer Target was doing a knockoff.?

For the same reason that the Navy chair name is probably generic (a lot of firms have produced very similar chairs under that name), the design almost certainly doesn?t indicate any single source of the product (because consumers have been getting their Navy chairs from a variety of sources for years). The bottom line is that Emeco can?t stop Restoration Hardware from knocking off the Navy chair.

(AP) ? The online version of China's Communist Party newspaper has hailed a report by The Onion naming North Korean dictator Kim Jong Un as the "Sexiest Man Alive" ? not realizing it is satire.

The People's Daily on Tuesday ran a 55-page photo spread on its website in a tribute to the round-faced leader, under the headline "North Korea's top leader named The Onion's Sexiest Man Alive for 2012."

Quoting The Onion's spoof report, the Chinese newspaper wrote, "With his devastatingly handsome, round face, his boyish charm, and his strong, sturdy frame, this Pyongyang-bred heartthrob is every woman's dream come true."

"Blessed with an air of power that masks an unmistakable cute, cuddly side, Kim made this newspaper's editorial board swoon with his impeccable fashion sense, chic short hairstyle, and, of course, that famous smile," the People's Daily cited The Onion as saying.

The photos the People's Daily selected include Kim on horseback squinting into the light and Kim waving toward a military parade. In other photos, he is wearing sunglasses and smiling, or touring a facility with his wife.

People's Daily could not immediately be reached for comment. A man who answered the phone at the newspaper's duty office said he did not know anything about the report and requested queries be directed to their newsroom on Wednesday morning.

It is not the first time a state-run Chinese newspaper has fallen for a fictional report by the just-for-laughs The Onion.

In 2002, the Beijing Evening News, one of the capital city's biggest tabloids at the time, published as news the fictional account that the U.S. Congress wanted a new building and that it might leave Washington. The Onion article was a spoof of the way sports teams threaten to leave cities in order to get new stadiums.

Two months ago, Iran's semiofficial Fars news agency reprinted a story from The Onion about a supposed survey showing that most rural white Americans would rather vote for Iranian President Mahmoud Ahmadinejad than President Barack Obama. It included a quote from a fictional West Virginia resident saying he'd rather go to a baseball game with Ahmadinejad because "he takes national defense seriously."

Home prices rise again as housing recovery continues

NEW YORK - Single-family home prices rose in September in a further sign that the housing market is on the mend, a closely watched survey showed on Tuesday.

The S&P/Case Shiller composite index of 20 metropolitan areas gained 0.4 percent in September on a seasonally adjusted basis, in line with economists' forecasts.

"In September's report all three headline composites and 17 of the 20 cities gained over their levels of a year ago," David Blitzer, chairman of the index committee at Standard & Poor's, said in a statement.

Prices in the 20 cities rose 3.0 percent year over year, just topping expectations for a rise of 2.9 percent

About 2,000 Koi Pulled From Thunderbird Lake In East Boulder ...

BOULDER, Colo. (CBS4) ? It?s a fish that can brighten a backyard garden, but when koi take over a lake, it can be trouble.

On Monday Colorado Parks and Wildlife removed close to 2,000 of the invasive fish from Thunderbird Lake in East Boulder. Where the koi came from is a mystery.

?It wasn?t something we released; we had no knowledge of it, so it?s a big question mark,? Joy Master with Boulder Parks and Recreation said.

It was earlier this year when officials with Boulder Parks and Recreation began to notice changes in the pond?s ecosystem. That?s when the non-native fish were spotted.

?Unfortunately we think someone may have dumped them here,? Jennifer Churchill with Colorado Parks and Wildlife said.

What may have been just a few fish dumped in the lake a few years ago has now turned into a big problem.

?They?ve pretty much taken over the fishery,? Churchill said.

So workers with Colorado Parks and Wildlife have been fishing them out.

?What we do is we shock the fish, they rise to the surface,? Churchill said. ?They?re still alive, they?re just stunned and so we?re able to scoop them out with a net.?

Churchill says without their removal it could harm the lake by killing off native fish species and spreading diseases.

?It really just throws the ecosystem out of balance,? she said.

All of the fish taken out of the lake will be given to the Birds of Prey Sanctuary, which is a raptor rehabilitation program in Broomfield.

Colorado Parks and Wildlife says it?s never a good idea to release non-native species into the wild. Contact the Humane Society if you can no longer keep your pet.
